  • SAM Registration: Vendors must be registered and in good standing with the System for Award Management (SAM.gov).
  • Compliance Certifications: Vendors must provide proof of compliance with applicable regulations, including:
    • Buy American Act (BAA) and Trade Agreements Act (TAA).
    • Cybersecurity Maturity Model Certification (CMMC) for IT-related goods and services.
    • Environmental and sustainability certifications, if applicable.
  • Socioeconomic Status: Vendors claiming socioeconomic designations (e.g., Small Business, Veteran-Owned Business) must provide valid certifications.
  • Legal Capacity: Vendors must have the legal authority to enter into agreements with the U.S. government.

3. Prohibited Activities

Vendors and users of this platform agree not to:

  • Post or sell items prohibited under federal law, including restricted telecommunications equipment under Section 889 of the National Defense Authorization Act (NDAA).
  • Provide false, misleading, or incomplete information in their listings or communications.
  • Engage in fraudulent or deceptive practices.
  • Violate intellectual property rights or post unauthorized content.

4. Compliance with Federal and Army Regulations

All transactions conducted through this platform must adhere to the following regulations and policies:

  • Federal Acquisition Regulation (FAR): Governing federal procurement processes.
  • Defense Federal Acquisition Regulation Supplement (DFARS): For Department of Defense acquisitions.
  • Army Federal Acquisition Regulation Supplement (AFARS): Specific to Army procurement.
  • IT and Cybersecurity Standards: Vendors providing IT-related goods or services must comply with:
    • NIST SP 800-171 (Cybersecurity standards for non-federal systems).
    • Federal Risk and Authorization Management Program (FedRAMP) standards for cloud services.
  • Export Control Laws: Vendors must ensure compliance with applicable export control regulations, such as the International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR).

5. Listings and Product Standards

Vendors must ensure that all listings:

  • Contain accurate and detailed product descriptions, specifications, and compliance certifications.
  • Do not include restricted or unauthorized items, including counterfeit goods or those banned by federal regulations.
  • Align with Army mission readiness requirements, including durability, technical specifications, and sustainability goals.

6. Data Security and Privacy

Vendors and users must:

  • Adhere to strict data protection and privacy measures, including encryption and secure handling of sensitive information.
  • Comply with Army and DoD-specific security requirements for any shared data or transactions.

The marketplace implements industry-standard cybersecurity protocols to protect user data. However, vendors are responsible for ensuring the security of their listings and communications.

7. Payment and Transactions

All payments must comply with federal financial regulations and may utilize systems such as Wide Area Workflow (WAWF) for eligible contracts. No vendor fees will be charged for participation on this platform.

8. Performance Monitoring and Reporting

The platform reserves the right to monitor vendor performance to ensure compliance with:

  • Delivery schedules.
  • Quality standards as defined by the purchase agreement or contract.
  • Applicable performance metrics (e.g., timeliness, product conformity).

Failure to meet these standards may result in suspension or removal from the platform.

9. Termination and Suspension

The marketplace may suspend or terminate a vendor’s account for:

  • Non-compliance with these Terms.
  • Violation of federal or Army procurement regulations.
  • Misrepresentation or fraudulent activity.
  • Failure to meet platform performance metrics.

10. Limitation of Liability

The marketplace provides a platform for transactions but does not assume liability for:

  • Vendor non-performance or product defects.
  • Delays or failures due to third-party services.
  • Losses resulting from user violations of these Terms or applicable laws.

11. Changes to Terms

The marketplace reserves the right to modify these Terms at any time. Updates will be communicated via the website, and continued use of the platform constitutes acceptance of the updated Terms.
